This Privacy Policy describes how WhaleX Arts Foundation collects, uses, maintains, discloses, and protects personal information obtained through www.whalexarts.org, related webpages, membership services, donation services, electronic communications, program inquiries, and grant or financial-support applications administered by WhaleX Arts Foundation.
This Privacy Policy does not govern websites, payment platforms, aviation service providers, flight schools, medical examiners, or other services operated independently by third parties.
INFORMATION COLLECTED BY WHALEX ARTS FOUNDATION
2.1 Information Provided Directly
WhaleX Arts Foundation may collect personal information voluntarily provided by an individual, including:
(a) name, email address, telephone number, and mailing address;
(b) membership registration and account information;
(c) donation and transaction information;
(d) communications submitted to WhaleX Arts Foundation;
(e) program, event, volunteer, and application information;
(f) age or date-of-birth information when reasonably necessary to determine program eligibility;
(g) parent or legal-guardian information when an applicant or participant is a minor;
(h) aviation education, flight-training, instructor, flight-school, logbook, eligibility, invoice, receipt, and reimbursement information;
(i) information reasonably necessary to evaluate or administer a grant, award, reimbursement, or charitable program; and
(j) photographs, recordings, testimonials, or similar materials when separately authorized.
2.2 Information Collected Automatically
When an individual visits the website, WhaleX Arts Foundation or its service providers may automatically collect limited technical information, including Internet Protocol address, browser type, device type, operating system, referring website, pages viewed, approximate location derived from an Internet Protocol address, access dates and times, and cookie or website-log information.
2.3 Information Received From Third Parties
WhaleX Arts Foundation may receive information from service providers involved in website hosting, payment processing, communications, membership administration, analytics, fraud prevention, flight training, medical-examination verification, or program administration.
WhaleX Arts Foundation will request information from a flight school, flight instructor, aviation medical examiner, or other program provider only when reasonably necessary and, where appropriate, with the applicant’s or participant’s authorization.
PURPOSES FOR WHICH INFORMATION MAY BE USED
WhaleX Arts Foundation may use personal information to:
(a) operate and maintain the website;
(b) respond to inquiries and communicate with supporters, members, applicants, participants, parents, and legal guardians;
(c) process donations and issue acknowledgments;
(d) administer memberships and recurring subscription payments;
(e) evaluate, verify, approve, deny, and administer program or financial-support applications;
(f) verify expenses, receipts, eligibility, enrollment, training, or program participation;
(g) make payments or reimbursements authorized under a charitable program;
(h) maintain financial, tax, accounting, corporate, grant, and program records;
(i) prevent fraud, misuse, security incidents, and unlawful activity;
(j) improve the website and charitable programs;
(k) comply with legal, regulatory, insurance, audit, and reporting obligations; and
(l) protect the safety, rights, property, and legitimate interests of WhaleX Arts Foundation and other persons.
PAYMENT INFORMATION
Donations, membership payments, and other payments may be processed by Stripe, Bandzoogle, or another third-party payment processor.
WhaleX Arts Foundation does not intend to receive or store complete payment-card numbers, card security codes, or complete bank-account credentials submitted directly to a payment processor. Payment information handled by a third-party processor is subject to that processor’s terms and privacy practices.
WhaleX Arts Foundation may receive limited transaction information, including the payer’s name, contact information, payment amount, transaction date, subscription status, and payment confirmation.
DISCLOSURE OF INFORMATION
WhaleX Arts Foundation does not sell or rent personal information.
WhaleX Arts Foundation may disclose personal information:
(a) to vendors and service providers performing services for WhaleX Arts Foundation;
(b) to payment processors, website hosts, email providers, accountants, auditors, legal advisers, insurers, and technology providers;
(c) to flight schools, instructors, aviation medical examiners, program partners, or other providers when reasonably necessary to evaluate or administer an authorized program;

If WhaleX Arts Foundation learns that personal information was collected directly from a child under thirteen without appropriate authorization, WhaleX Arts Foundation will take reasonable steps to delete the information.
Participation by a person under eighteen may require a parent or legal guardian to complete separate consent, release, medical-authorization, emergency-contact, and program documents.
MEDICAL AND OTHER SENSITIVE INFORMATION
Applicants should not transmit Social Security numbers, complete medical records, diagnostic records, government identification documents, or other highly sensitive information through an initial application email unless WhaleX Arts Foundation specifically requests the information and provides an approved method for transmitting it.
Information concerning an aviation medical examination may be limited to information reasonably necessary to establish eligibility, verify completion, evaluate an expense, or administer an approved reimbursement.
WhaleX Arts Foundation is not a health-care provider or health plan, and the website should not be used to obtain medical advice or emergency assistance.
INFORMATION SECURITY
WhaleX Arts Foundation uses reasonable administrative, technical, and organizational measures appropriate to the nature of the information maintained by WhaleX Arts Foundation.
No website, email system, payment system, transmission method, or electronic storage system can be guaranteed to be completely secure. Accordingly, WhaleX Arts Foundation cannot guarantee the absolute security of information transmitted or maintained electronically.
This provision does not limit any duty or liability that cannot lawfully be limited.
RETENTION
WhaleX Arts Foundation may retain personal information for as long as reasonably necessary to fulfill the purposes described in this Privacy Policy, administer memberships or programs, comply with accounting and tax obligations, maintain grant and corporate records, resolve disputes, prevent fraud, enforce agreements, and comply with applicable law.
Information that is no longer reasonably required may be deleted, anonymized, or securely archived, subject to applicable record-retention requirements.
PRIVACY REQUESTS AND COMMUNICATION PREFERENCES
An individual may contact WhaleX Arts Foundation to:
(a) request access to personal information previously provided to WhaleX Arts Foundation;

Unsubscribing from promotional communications does not prevent WhaleX Arts Foundation from sending necessary transactional, membership, application, donation, safety, or program-administration communications.

WhaleX Arts Foundation is a nonprofit organization. The California Consumer Privacy Act generally does not apply directly to nonprofit organizations. ACCEPTANCE OF TERMS
These Website Terms and Conditions of Use govern access to and use of www.whalexarts.org and related webpages, content, membership services, donation services, and online features operated by WhaleX Arts Foundation.
By accessing or using the website, submitting information, purchasing a membership, or making a donation, the user acknowledges these Website Terms and Conditions of Use. If a user does not agree to these terms, the user should not use the website’s transactional or registration features.
A person under eighteen years of age may participate in a program only with any consent or authorization required from a parent or legal guardian.
ORGANIZATIONAL PURPOSE
WhaleX Arts Foundation is a California-based tax-exempt public charity recognized under Section 501(c)(3) of the Internal Revenue Code. WhaleX Arts Foundation supports young women pursuing opportunities in aviation, aviation education, exploration, and related charitable activities.
Descriptions appearing on the website are provided for general informational purposes and do not create a contractual entitlement to services, participation, reimbursement, funding, or any particular result.
MEMBERSHIP AND AUTOMATIC RENEWAL
3.1 Young Aviator Membership
The current Young Aviator Membership price is three dollars ($3.00) per month unless a different price is clearly disclosed before purchase.
3.2 Automatic Monthly Renewal
A Young Aviator Membership automatically renews each month, and the payment method provided by the member will be charged the applicable monthly membership fee until the member cancels the subscription.
The price, billing frequency, automatic-renewal terms, and cancellation method must be displayed clearly before the member authorizes payment.
3.3 Cancellation
A member may cancel a Young Aviator Membership at any time by using the online cancellation method provided in the member’s account or subscription confirmation, or by submitting an electronic cancellation request to info@whalexarts.org.
A cancellation request submitted by email should include the member’s name and the email address associated with the membership account. WhaleX Arts Foundation will not require a member to state a reason for cancellation.
Cancellation applies to future billing periods. Cancellation does not ordinarily reverse a payment already completed for the then-current billing period, except when a refund is required by applicable law or authorized by WhaleX Arts Foundation.
If an application has been formally accepted for review while the applicant’s Young Aviator Membership is active, a subsequent cancellation of the membership will not, by itself, disqualify that application from the current review process.
3.4 Membership Benefits
Membership benefits may include access to designated content, notices, resources, or eligibility to submit applications for certain programs. Available benefits may be revised prospectively.
Membership does not guarantee acceptance into a program, approval of an application, reimbursement, financial assistance, flight training, an aviation medical certificate, or any other award or result.
The amount or duration of membership fees paid will not increase or decrease an applicant’s likelihood of receiving an award.
3.5 Tax Treatment
Membership fees are payments for membership status or associated benefits and should not automatically be treated as charitable contributions. Each member is responsible for consulting the member’s own tax adviser regarding any claimed tax treatment.
DONATIONS
Donations support the charitable mission and programs of WhaleX Arts Foundation.
A donation may be tax-deductible only to the extent permitted by applicable law. WhaleX Arts Foundation does not provide individual legal or tax advice, and donors should consult their own advisers.
Unless WhaleX Arts Foundation expressly accepts a donation in writing for a specified restricted purpose, WhaleX Arts Foundation retains discretion and control over the use of donated funds in furtherance of its charitable purposes.
Donations are generally final after processing, except when a refund is required by law, a payment was processed in error, or WhaleX Arts Foundation authorizes a refund under the circumstances.
PROGRAMS, GRANTS, AWARDS, AND REIMBURSEMENTS
5.1 No Entitlement
Information concerning grants, aviation medical-examination support, flight-training support, aviation education, mentorship, events, or other opportunities constitutes a description of a potential charitable program. It does not constitute a promise or guarantee of participation, selection, payment, reimbursement, or continued availability.
5.2 Eligibility and Review
WhaleX Arts Foundation may establish and revise lawful eligibility requirements, application periods, documentation requirements, selection criteria, award amounts, and funding limits.
Applications may be evaluated according to charitable purpose, demonstrated need, aviation goals, readiness, available funding, completeness of documentation, and other published program criteria.
All decisions are subject to available charitable funds and the independent discretion of WhaleX Arts Foundation. A decision is effective only when communicated in an authorized written award or approval notice.
5.3 Supporting Documentation
WhaleX Arts Foundation may require receipts, invoices, enrollment verification, instructor or flight-school information, training records, proof of payment, proof of eligibility, or other reasonable documentation.
False, misleading, altered, or materially incomplete information may result in denial, withdrawal of approval, termination of an award, or a request for repayment, subject to applicable law.
5.4 Payment Method
WhaleX Arts Foundation may reimburse an approved expense, pay an approved provider directly, or use another payment method stated in the written award notice.
No expense is eligible for reimbursement unless it complies with the applicable program rules and any required written preapproval.
5.5 Tax and Reporting Responsibilities
A recipient is responsible for determining whether an award, reimbursement, or other payment has any tax, reporting, licensing, or financial-aid consequences for that recipient.
AVIATION AND MEDICAL MATTERS
6.1 Inherent Aviation Risks
Aircraft operations, flight instruction, discovery flights, airport activities, and other aviation activities involve inherent and potentially serious risks, including property damage, bodily injury, permanent disability, and death.
6.2 Independent Providers
Unless expressly stated in a written agreement, WhaleX Arts Foundation is not an air carrier, aircraft operator, flight school, flight instructor, aviation medical examiner, maintenance provider, or airport operator.
Flight schools, pilots, instructors, aircraft operators, aviation medical examiners, and other service providers are independently responsible for their own qualifications, licensing, operations, professional judgment, safety procedures, insurance, services, and legal compliance.
Financial support or referral by WhaleX Arts Foundation does not constitute a warranty, certification, employment relationship, partnership, or guarantee concerning any independent provider.
6.3 No Medical or Certification Guarantee
Information on the website does not constitute medical advice, aviation legal advice, flight instruction, or a determination of eligibility for an aviation certificate.
Payment or reimbursement of an aviation medical examination does not guarantee that an applicant will receive or retain an aviation medical certificate. Decisions concerning aviation medical certification are made by the responsible aviation medical examiner and applicable governmental authorities.
6.4 Separate Participation Documents
Participation in a flight, training activity, event, or other aviation program may require separate eligibility verification, informed consent, assumption-of-risk documentation, liability releases, emergency information, insurance documentation, and, for a minor, parent or legal-guardian authorization.
These Website Terms and Conditions of Use do not replace any program-specific agreement or aviation-activity release.
WEBSITE INFORMATION
Website content is provided for general informational, educational, and charitable purposes. Although WhaleX Arts Foundation seeks to present accurate and current information, website content may contain errors, omissions, or outdated information.
Program descriptions, dates, eligibility requirements, award amounts, personnel, and available resources may change. The most recent authorized written program rules or award notice will control in the event of a conflict.
